By accessing and using FitPlan PRO, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

FitPlan PRO provides personalized fitness and nutrition planning services, including:

  • Customized 3-month progressive workout plans
  • Personalized meal plans with 400+ recipes
  • Exercise demonstration videos
  • Progress tracking and calorie counter
  • Water intake tracking

3. Free and Paid Plans

Free Plan

The free plan provides access to 1-week workout plans, 1-week meal plans, basic calorie tracking, and exercise videos.

Pro Plan (€29.99)

The Pro plan provides 3-month access to complete progressive workout plans, full meal plans, progress tracking charts, and all premium features.

4. Payment Terms

Payments are processed securely through GoCardless. By purchasing the Pro plan, you agree to:

  • Pay the one-time fee of €29.99 for 3-month access to all premium features
  • Provide accurate payment information
  • Comply with GoCardless's terms and conditions

All sales are final. Due to the digital nature of our service and immediate access upon payment, we do not offer refunds except as required by law.

5. Health and Medical Disclaimer

IMPORTANT HEALTH NOTICE:

FitPlan PRO provides general fitness and nutrition information for educational purposes only. This service is NOT a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult with a qualified healthcare provider before starting any fitness program
  • Seek immediate medical attention if you experience pain, dizziness, or discomfort during exercise
  • Individual results may vary based on various factors including genetics, effort, and consistency
  • We are not responsible for any injuries or health issues that may occur from following our plans

6. User Responsibilities

You agree to:

  • Provide accurate and complete information when using our service
  • Use the service only for lawful purposes
  • Not share your Pro plan access with others
  • Not attempt to reverse engineer or copy our proprietary content
  • Exercise at your own risk and within your physical capabilities

7. Intellectual Property

All content, features, and functionality of FitPlan PRO, including but not limited to workout plans, meal plans, text, graphics, logos, and software, are owned by Sandy Smajic Consulting and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Sandy Smajic Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of FitPlan PRO.

9. Changes to Service

We reserve the right to modify, suspend, or discontinue any part of FitPlan PRO at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

10. Termination

We may terminate or suspend your access to FitPlan PRO immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable local jurisdiction, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of FitPlan PRO after changes constitutes acceptance of the new Terms.
